1. Definitions
In these Terms, the following definitions apply:
- "Platform" means the Domovita website at domovita.co.uk and any related mobile or web applications.
- "We", "Us", "Our" means Domovita Ltd, Company No. 17033259.
- "You", "User" means any person or organisation accessing or using the Platform.
- "Agent" means a registered estate agent, letting agent, or property professional who registers and is verified for an Agent account. Agent accounts are free; there is no agent subscription or listing fee.
- "Private Seller" or "Private Landlord" means an individual listing property in a personal capacity rather than as a property professional.
- "Listing" means a property advertisement submitted by an Agent or private seller.
- "Branch" means a single office location registered under an Agent account.
- "Content" means any text, images, data, or other material submitted to or displayed on the Platform.
- "Paid Feature" means an optional, separately-purchased add-on, currently a Featured Listing (promoted placement) and premium tools or services for private sellers and consumers. No Paid Feature is required in order to list.
2. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Platform.
We reserve the right to update or amend these Terms at any time. For material changes, we will provide at least 30 days' written notice by email to the address registered on your account. Continued use of the Platform after the effective date of any changes constitutes acceptance of the revised Terms.
3. Account Registration
3.1 Eligibility
You must be at least 18 years of age to create an account. By registering, you confirm that you meet this requirement and that you are authorised to enter into a binding agreement on behalf of any business you represent.
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at
3.3 Accuracy
You agree to provide accurate, current, and complete information during registration and to keep that information up to date. We reserve the right to suspend or terminate accounts where information is found to be false, misleading, or incomplete.
4. Agent Accounts
4.1 Free for Agents
Listing on Domovita is free for Agents. There is no subscription, no per-branch fee, no listing fee, no setup fee, and no minimum term. Verified Agents may list an unlimited number of properties at no cost, and there is no contract to sign or cancel. This is a standing commitment, not a promotional rate or a trial that converts to a paid plan.
4.2 Organic Ranking Is Not for Sale
Agents cannot pay to manipulate organic search position, and valuation leads are distributed by a fair rotation rather than by spend. The only paid visibility is the optional Featured Listing described in Section 4.4.
4.3 Branch Listings
Properties listed by a Branch are shared across that Branch's team members. There is no listing limit, and listings do not count towards any quota.
4.4 Optional Paid Features
The following are optional and are never required in order to list:
- Featured Listings - a promoted-placement upgrade that any person who owns a listing may purchase (including Agents). Featured placement is capped per area, is clearly labelled, and does not affect organic search ranking. Pricing and availability are confirmed at the time of purchase.
- Premium tools and services for private sellers and consumers - optional add-ons offered to non-Agent users. Pricing is confirmed at the time of purchase.
Paid Features are billed via our payment processor, Stripe. By purchasing a Paid Feature you authorise us to charge the payment method on file in accordance with the terms presented at checkout (for any recurring Paid Feature, on a recurring basis until you cancel).
5. Changes to Paid Features
5.1 Scope
This section applies only to the optional Paid Features described in Section 4.4. It does not apply to Agent listing, which is and remains free.
5.2 Right to Adjust
We may introduce, withdraw, or adjust the price of an optional Paid Feature from time to time to reflect changes in our operating costs, third-party service charges, inflation, or market conditions.
5.3 Notice
For any recurring Paid Feature you hold, we will provide at least 30 days' written notice of a price change by email to the address registered on your account. Notice will clearly state the new pricing and the date from which it takes effect.
5.4 Your Options
If you do not accept a price change to a recurring Paid Feature, you may cancel that Paid Feature before the new pricing takes effect. Continued use of the Paid Feature after the effective date of any price change constitutes acceptance of the new pricing.
5.5 No Retrospective Changes
Price changes will not apply retrospectively to any billing period that has already commenced.
6. Cancellation and Refunds
6.1 Closing Your Account
You may stop using your Agent account at any time through your account settings or by contacting us at
6.2 Cancelling a Paid Feature
You may cancel any optional Paid Feature at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you retain that Paid Feature until the end of that period.
6.3 Suspension or Termination by Us
We may suspend or terminate your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. We will notify you of any such action as soon as reasonably practicable.
6.4 Refunds
Fees paid for optional Paid Features are non-refundable except where required by applicable law or in exceptional circumstances at our sole discretion. If you cancel a recurring Paid Feature mid-period, you will not receive a pro-rata refund for the unused portion of that period.
6.5 Effect of Suspension or Termination
Upon suspension or termination of your account:
- Affected team members will lose the ability to submit new Listings.
- Existing published Listings will remain visible for a reasonable wind-down period (typically 14 days), during which you may export your listing data, after which they may be removed from public view.
- Your account data will be retained or deleted in accordance with our Privacy Policy.
7. Property Listings
7.1 Your Responsibilities
As an Agent or private seller, you are solely responsible for ensuring that all Listings you submit comply with applicable law, including but not limited to:
- The Digital Markets, Competition and Consumers Act 2024 (which replaced the Consumer Protection from Unfair Trading Regulations 2008 on 6 April 2025)
- The Estate Agents Act 1979
- Energy Performance Certificate (EPC) regulations (properties must have a valid EPC where required by law)
- The Tenant Fees Act 2019
You must ensure that all information in your Listings is accurate, complete, and not misleading.
7.2 Prohibited Content
You must not submit Listings or other Content that:
- Is false, misleading, or deceptive
- Infringes any third-party intellectual property rights
- Contains defamatory, offensive, or discriminatory material
- Violates any applicable law or regulation
- Includes personal data in contravention of UK GDPR or the Data Protection Act 2018
- Advertises properties that are not genuinely available
- Includes pricing or fees that are not permitted under the Tenant Fees Act 2019
7.3 Moderation
We reserve the right to review, edit, or remove any Listing or Content at any time without prior notice if we reasonably believe it violates these Terms or applicable law. We are not obligated to monitor all Content but may do so at our discretion.
7.4 Licence to Content
By submitting a Listing or other Content to the Platform, you grant Domovita Ltd a non-exclusive, royalty-free, worldwide licence to display, reproduce, distribute, and adapt that Content for the purposes of operating and promoting the Platform. You retain ownership of your Content and may remove it at any time subject to these Terms.
7.5 Rental Listings and Landlord Compliance
For rental listings, you must additionally comply with the following requirements:
- Equality Act 2010: You must not include blanket exclusions based on benefit status (such as "No DSS" or equivalent). All such exclusions are prohibited and listings containing them will be removed.
- Energy Performance: Rental properties must have a valid EPC with a rating of E or above (or a valid exemption). We reserve the right to remove listings for properties that do not meet minimum energy efficiency standards.
- Tenant Fees Act 2019: All listed deposits and fees must comply with statutory caps. Prohibited fees must not be advertised.
- Tenant Information: Landlords must serve tenants with the current Government Renters’ Rights Act Information Sheet 2026 (which replaced the withdrawn How to Rent guide when the Renters’ Rights Act 2025 came into force on 1 May 2026) at the commencement of the tenancy. Always serve the current official version from GOV.UK.
- Right to Rent: Landlords are responsible for conducting Right to Rent checks as required by the Immigration Act 2014.
- Material Information: Listings must include all material information required under the Digital Markets, Competition and Consumers Act 2024, as enforced by the Competition and Markets Authority (CMA). (The earlier National Trading Standards / NTSELAT guidance was withdrawn in May 2025 when enforcement passed to the CMA.)
We will remove listings that we identify as non-compliant with these requirements without prior notice.
8. Property Data Feeds
8.1 Automated Feeds
Agents may submit property listings via automated data feeds in supported formats including BLM, XML, CSV, and JSON. Feed submissions must conform to our published feed specification, which is available in your account dashboard.
8.2 Feed Frequency
Feed processing frequency may vary. We do not guarantee real-time publication of feed-submitted listings. Listings will be processed and published as soon as reasonably practicable following receipt of the feed.
8.3 Data Ownership
Data submitted via automated feeds remains the property of the submitting Agent. By submitting a feed, you grant Domovita Ltd the same licence to Content as described in Section 7.4.
9. Acceptable Use
You agree not to use the Platform to:
- Scrape, harvest, or systematically extract data from the Platform without our prior written consent
- Transmit any unsolicited commercial communications (spam)
- Introduce malware, viruses, or other harmful code
- Attempt to gain unauthorised access to any part of the Platform or its underlying systems
- Impersonate any person or organisation
- Use automated tools to interact with the Platform in a manner that places excessive load on our infrastructure
- Circumvent any access controls, rate limits, or security measures
- Use the Platform for any unlawful purpose or in a manner that infringes the rights of others
- Interfere with other users’ use of the Platform
10. Intellectual Property
10.1 Our Rights
All intellectual property rights in the Platform, including its design, software, trade marks, logos, and original content, are owned by or licensed to Domovita Ltd. Nothing in these Terms grants you any right to use our intellectual property except as expressly permitted.
10.2 Your Rights
You retain all intellectual property rights in the Content you submit. You represent and warrant that you own or have the necessary licences, rights, consents, and permissions to submit your Content to the Platform and to grant the licence described in Section 7.4.
11. Data Protection and Privacy
We process personal data in accordance with our Privacy Policy, which forms part of these Terms. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.
Where you submit personal data relating to third parties (such as property owners or tenants) through the Platform, you confirm that you have the necessary lawful basis to do so under UK GDPR and the Data Protection Act 2018, and that you have provided those individuals with appropriate privacy information.
12. Disclaimers
12.1 Availability
We endeavour to maintain the Platform in continuous operation but do not guarantee uninterrupted availability. The Platform is provided "as is" and we make no warranty that it will meet your requirements or be free from errors or interruptions. We reserve the right to suspend the Platform temporarily for maintenance, updates, or other operational reasons.
12.2 Third-Party Data
The Platform may display data sourced from third parties, including but not limited to Ofsted school ratings, local authority information, Ordnance Survey mapping, Energy Performance Certificate registers, and broadband availability data. We do not warrant the accuracy, completeness, or currency of any third-party data. You should independently verify any third-party data before relying on it.
12.3 No Professional Advice
Nothing on the Platform constitutes legal, financial, tax, surveying, or other professional advice. You should obtain independent professional advice before making any property-related decision.
13. Limitation of Liability
13.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, Domovita Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, or loss of goodwill, arising out of or in connection with your use of the Platform.
13.2 Cap on Liability
Our total aggregate liability to you in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees you have paid us, if any, in the 12 months immediately preceding the event giving rise to the claim. As Agent listing is free, where no fees have been paid our total aggregate liability is limited to one hundred pounds (£100).
13.3 Statutory Rights
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. Your statutory rights are not affected by these Terms.
14. Indemnification
You agree to indemnify, defend, and hold harmless Domovita Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Platform in violation of these Terms
- Any Content you submit that infringes the rights of any third party or violates any applicable law
- Any breach by you of any representation or warranty contained in these Terms
15. Referral and Partner Arrangements
Domovita may make available features or links that connect users with third-party service providers relevant to property transactions, including but not limited to: mortgage advisers and brokers, property surveyors and valuers, removal and storage companies, insurance and broadband providers, and other home-moving services. Domovita does not offer, arrange or receive fees for conveyancing or any other legal service (“Referral Partners”).
Where such connections or referrals are made available, Domovita may receive referral fees or commission payments from those providers when a user engages their services through or following a referral from the Platform. The existence of any such arrangement does not affect the price you pay for those services.
Where referral arrangements are in place, this will be disclosed clearly to users at the point at which they are offered a connection, recommendation, or quote.tive.
Your use of any third-party service accessed through or referred by the Platform is entirely voluntary. Domovita does not act as an agent or adviser for any Referral Partner, and is not responsible for the services provided by any third-party provider. Any contract for services is solely between you and the relevant provider.
Where we refer you to providers of regulated financial products (including mortgages, insurance, or investment advice), we will comply with all applicable Financial Conduct Authority requirements regarding disclosure and referral transparency.
16. Reporting and Complaints
If you believe a listing on the Platform is inaccurate, misleading, or in breach of these Terms, you may report it using the “Report this listing” link on the relevant listing page, or by emailing
We will investigate all reports in good faith and aim to respond within 5 working days. Where we determine that a listing is in breach of these Terms or applicable law, we may remove the listing or suspend the relevant account without prior notice.

17.1 Informal Resolution
In the event of any dispute arising out of or in connection with these Terms or your use of the Platform, you agree to first attempt to resolve the dispute informally by contacting us at
17.2 Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
17.3 Jurisdiction
Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies or notices published on the Platform, constitute the entire agreement between you and Domovita Ltd with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.
18.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision or any other provision in the future.
18.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any successor entity in connection with a merger, acquisition, or sale of all or substantially all of our assets.
