1. Definitions
In these Terms, the following definitions apply:
- "Platform" means the Domovita website at domovita.co.uk and any related mobile or web applications.
- "We", "Us", "Our" means Domovita Ltd, Company No. 17033259.
- "You", "User" means any person or organisation accessing or using the Platform.
- "Agent" means a registered estate or letting agent subscribing to a paid plan.
- "Listing" means a property advertisement submitted by an Agent or private seller.
- "Branch" means a single office location registered under an Agent account.
- "Content" means any text, images, data, or other material submitted to or displayed on the Platform.
- "Subscription" means a paid plan providing access to Platform features.
2. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Platform.
We reserve the right to update or amend these Terms at any time. For material changes, we will provide at least 30 days' written notice by email to the address registered on your account. Continued use of the Platform after the effective date of any changes constitutes acceptance of the revised Terms.
3. Account Registration
3.1 Eligibility
You must be at least 18 years of age to create an account. By registering, you confirm that you meet this requirement and that you are authorised to enter into a binding agreement on behalf of any business you represent.
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at
3.3 Accuracy
You agree to provide accurate, current, and complete information during registration and to keep that information up to date. We reserve the right to suspend or terminate accounts where information is found to be false, misleading, or incomplete.
4. Subscription Plans and Fees
4.1 Plans
We offer the following subscription plans for estate and letting agents:

All prices are exclusive of VAT, which will be charged at the applicable rate.
4.2 Free Trial
We may offer a free trial period at our discretion. The terms and duration of any free trial will be stated at the time of sign-up. At the end of the trial, your account will automatically transition to the selected paid plan unless you cancel before the trial expires.
4.3 Billing
Subscriptions are billed monthly in advance via Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis. Invoices will be sent to your registered email address.
4.4 Quota per Branch
The listing quota applies per registered Branch. If you operate multiple branches, each Branch requires its own subscription. Listings in excess of your plan quota will not be published until you upgrade or remove existing listings to bring your total within quota.
4.5 Featured Listings
Featured listing slots may be available as an optional add-on to any subscription plan. Featured listings receive enhanced visibility on search results pages. Pricing and availability of featured slots will be displayed within your account dashboard.
5. Price Adjustments
5.1 Right to Adjust
We reserve the right to adjust subscription prices at any time, subject to the notice provisions set out in this section.
5.2 Notice
We will provide at least 30 days' written notice of any price increase by email to the address registered on your account. Notice will clearly state the new pricing and the date from which it takes effect.
5.3 Your Options
If you do not accept a price increase, you may downgrade to a lower plan or cancel your subscription before the new pricing takes effect. Continued use of the Platform after the effective date of any price change constitutes acceptance of the new pricing.
5.4 No Retrospective Changes
Price changes will not apply retrospectively to any billing period that has already commenced.
6. Cancellation and Refunds
6.1 Cancellation by You
You may cancel your subscription at any time through your account settings or by contacting us at
6.2 Suspension or Termination by Us
We may suspend or terminate your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. We will notify you of any such action as soon as reasonably practicable.
6.3 Refunds
Subscription fees are non-refundable except where required by applicable law or in exceptional circumstances at our sole discretion. If you cancel mid-month, you will not receive a pro-rata refund for the unused portion of the billing period.
6.4 Effect of Cancellation
Upon cancellation or termination of your account:
- Your Branch will be suspended and your Listings will be removed from public view.
- You will have a 14-day wind-down period during which you may export your listing data.
- After the wind-down period, your account data may be deleted in accordance with our Privacy Policy.
7. Property Listings
7.1 Your Responsibilities
As an Agent or private seller, you are solely responsible for ensuring that all Listings you submit comply with applicable law, including but not limited to:
- The Consumer Protection from Unfair Trading Regulations 2008
- The Property Misdescriptions Act 2013
- The Estate Agents Act 1979
- Energy Performance Certificate (EPC) regulations (properties must have a valid EPC where required by law)
- The Tenant Fees Act 2019
You must ensure that all information in your Listings is accurate, complete, and not misleading.
7.2 Prohibited Content
You must not submit Listings or other Content that:
- Is false, misleading, or deceptive
- Infringes any third-party intellectual property rights
- Contains defamatory, offensive, or discriminatory material
- Violates any applicable law or regulation
- Includes personal data in contravention of UK GDPR or the Data Protection Act 2018
- Advertises properties that are not genuinely available
- Includes pricing or fees that are not permitted under the Tenant Fees Act 2019
7.3 Moderation
We reserve the right to review, edit, or remove any Listing or Content at any time without prior notice if we reasonably believe it violates these Terms or applicable law. We are not obligated to monitor all Content but may do so at our discretion.
7.4 Licence to Content
By submitting a Listing or other Content to the Platform, you grant Domovita Ltd a non-exclusive, royalty-free, worldwide licence to display, reproduce, distribute, and adapt that Content for the purposes of operating and promoting the Platform. You retain ownership of your Content and may remove it at any time subject to these Terms.
7.5 Rental Listings and Landlord Compliance
For rental listings, you must additionally comply with the following requirements:
- Equality Act 2010: You must not include blanket exclusions based on benefit status (such as "No DSS" or equivalent). All such exclusions are prohibited and listings containing them will be removed.
- Energy Performance: Rental properties must have a valid EPC with a rating of E or above (or a valid exemption). We reserve the right to remove listings for properties that do not meet minimum energy efficiency standards.
- Tenant Fees Act 2019: All listed deposits and fees must comply with statutory caps. Prohibited fees must not be advertised.
- How to Rent Guide: Landlords must provide tenants with the current version of the Government’s How to Rent guide at the commencement of the tenancy.
- Right to Rent: Landlords are responsible for conducting Right to Rent checks as required by the Immigration Act 2014.
- Material Information: Listings must include all material information required under applicable Consumer Protection regulations and as directed by the National Trading Standards Estate and Letting Agency Team (NTSELAT) guidance.
We will remove listings that we identify as non-compliant with these requirements without prior notice.
8. Property Data Feeds
8.1 Automated Feeds
Agents may submit property listings via automated data feeds in supported formats including BLM, XML, CSV, and JSON. Feed submissions must conform to our published feed specification, which is available in your account dashboard.
8.2 Feed Frequency
Feed processing frequency may vary. We do not guarantee real-time publication of feed-submitted listings. Listings will be processed and published as soon as reasonably practicable following receipt of the feed.
8.3 Data Ownership
Data submitted via automated feeds remains the property of the submitting Agent. By submitting a feed, you grant Domovita Ltd the same licence to Content as described in Section 7.4.
9. Acceptable Use
You agree not to use the Platform to:
- Scrape, harvest, or systematically extract data from the Platform without our prior written consent
- Transmit any unsolicited commercial communications (spam)
- Introduce malware, viruses, or other harmful code
- Attempt to gain unauthorised access to any part of the Platform or its underlying systems
- Impersonate any person or organisation
- Use automated tools to interact with the Platform in a manner that places excessive load on our infrastructure
- Circumvent any access controls, rate limits, or security measures
- Use the Platform for any unlawful purpose or in a manner that infringes the rights of others
- Interfere with other users’ use of the Platform
10. Intellectual Property
10.1 Our Rights
All intellectual property rights in the Platform, including its design, software, trade marks, logos, and original content, are owned by or licensed to Domovita Ltd. Nothing in these Terms grants you any right to use our intellectual property except as expressly permitted.
10.2 Your Rights
You retain all intellectual property rights in the Content you submit. You represent and warrant that you own or have the necessary licences, rights, consents, and permissions to submit your Content to the Platform and to grant the licence described in Section 7.4.
11. Data Protection and Privacy
We process personal data in accordance with our Privacy Policy, which forms part of these Terms. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.
Where you submit personal data relating to third parties (such as property owners or tenants) through the Platform, you confirm that you have the necessary lawful basis to do so under UK GDPR and the Data Protection Act 2018, and that you have provided those individuals with appropriate privacy information.
12. Disclaimers
12.1 Availability
We endeavour to maintain the Platform in continuous operation but do not guarantee uninterrupted availability. The Platform is provided "as is" and we make no warranty that it will meet your requirements or be free from errors or interruptions. We reserve the right to suspend the Platform temporarily for maintenance, updates, or other operational reasons.
12.2 Third-Party Data
The Platform may display data sourced from third parties, including but not limited to Ofsted school ratings, local authority information, Ordnance Survey mapping, Energy Performance Certificate registers, and broadband availability data. We do not warrant the accuracy, completeness, or currency of any third-party data. You should independently verify any third-party data before relying on it.
12.3 No Professional Advice
Nothing on the Platform constitutes legal, financial, tax, surveying, or other professional advice. You should obtain independent professional advice before making any property-related decision.
13. Limitation of Liability
13.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, Domovita Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, or loss of goodwill, arising out of or in connection with your use of the Platform.
13.2 Cap on Liability
Our total aggregate liability to you in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the total subscription fees paid by you in the 12 months immediately preceding the event giving rise to the claim.
13.3 Statutory Rights
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. Your statutory rights are not affected by these Terms.
14. Indemnification
You agree to indemnify, defend, and hold harmless Domovita Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Platform in violation of these Terms
- Any Content you submit that infringes the rights of any third party or violates any applicable law
- Any breach by you of any representation or warranty contained in these Terms
15. Referral and Partner Arrangements
Domovita may make available features or links that connect users with third-party service providers relevant to property transactions, including but not limited to: conveyancing solicitors and licensed conveyancers, mortgage advisers and brokers, property surveyors and valuers, removal and storage companies, and other home-moving services (“Referral Partners”).
Where such connections or referrals are made available, Domovita may receive referral fees or commission payments from those providers when a user engages their services through or following a referral from the Platform. The existence of any such arrangement does not affect the price you pay for those services.
Where referral arrangements are in place, this will be disclosed clearly to users at the point at which they are offered a connection, recommendation, or quote. A referral fee transparency disclosure will be published on the Platform when such services become active.
Your use of any third-party service accessed through or referred by the Platform is entirely voluntary. Domovita does not act as an agent or adviser for any Referral Partner, and is not responsible for the services provided by any third-party provider. Any contract for services is solely between you and the relevant provider.
Where we refer you to providers of regulated financial products (including mortgages, insurance, or investment advice), we will comply with all applicable Financial Conduct Authority requirements regarding disclosure and referral transparency.
16. Reporting and Complaints
If you believe a listing on the Platform is inaccurate, misleading, or in breach of these Terms, you may report it using the “Report this listing” link on the relevant listing page, or by emailing
We will investigate all reports in good faith and aim to respond within 5 working days. Where we determine that a listing is in breach of these Terms or applicable law, we may remove the listing or suspend the relevant account without prior notice.

17. Dispute Resolution
17.1 Informal Resolution
In the event of any dispute arising out of or in connection with these Terms or your use of the Platform, you agree to first attempt to resolve the dispute informally by contacting us at
17.2 Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
17.3 Jurisdiction
Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies or notices published on the Platform, constitute the entire agreement between you and Domovita Ltd with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.
18.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision or any other provision in the future.
18.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any successor entity in connection with a merger, acquisition, or sale of all or substantially all of our assets.
